Joint Rules of Procedure of the Bundestag and the Bundesrat for the Committee pursuant to Article 77, Basic Law (Mediation Committee) Joint Rules of Procedure of the Bundestag and the Bundesrat for the Committee

Of 5 May 1951 (Federal Law Gazette, Part II, p. 103), last amended pursuant to the Notification of 30th April 2003 (Federal Law Gazette, Part I, p. 677)

In order to implement Article 77, Basic Law, the Bundestag, with the consent of the Bundesrat, has adopted the following Rules of Procedure for the Mediation Committee:

§ 1 Permanent members

The Bundestag and Bundesrat shall each appoint 16 of their Members, who shall form the permanent Mediation Committee.

§ 2 Chair

The committee shall elect one Member of the Bundestag and one Member of the Bundesrat who shall alternate as Committee Chair every three months and shall deputize for each other.

§ 3 Alternates

An alternate shall be appointed for each committee member. The alternates must also be members of the institution by which they are appointed. Alternates may attend meetings of the committee only when required to deputize for a member.

§ 4 Replacement of Members and Alternates

The members and their alternates may be recalled; however, recall and replacement of members and alternates is admissible only four times within a single electoral term of the Bundestag.

§ 5 Federal Government

Members of the Federal Government may attend meetings of the committee and, should the committee so decide, shall be obliged to attend such meetings.

§ 6 Attendance of Other Persons

Other persons may be authorised to attend meetings of the committee only if a decision to this effect is taken by the committee.

§ 7 Quorum

(1) The committee shall be quorate if no fewer than twelve members are present, if members have been notified and have received the agenda no fewer than five days prior to the meeting in question.

(2)The period of notice shall begin when the notification is delivered to the mail sorting offices in the Bundestag and the Bundesrat.

(3) A compromise proposal may only be adopted if at least seven Members of the Bundestag and seven Members of the Bundesrat are present.

§ 8 Majority

The committee shall adopt decisions on the basis of a vote in favour by the majority of members present.

§ 9 Subcommittees

The committee may set up subcommittees.

§ 10 Procedure in the Bundestag

(1) A compromise proposal on amendment or withdrawal of a bill adopted by the Bundestag shall be placed on the agenda of the Bundestag without delay. A member appointed by the committee shall report to the Bundestag and the Bundesrat.

(2) The Bundestag shall vote only on the compromise proposal. Statements on the proposal may be submitted before the vote is taken. No other substantive motion pertaining to the proposal shall be admitted.

(3) Should the compromise proposal provide for several amendments to the adopted bill, the compromise proposal shall stipulate whether and to what extent a single vote will be taken on all or some of these amendments in the Bundestag. Should the compromise proposal contain amendments to the Basic Law, any departure in the proposal from the text of the bill adopted by the Bundestag pursuant to Article 79, Sub-section (2), Basic Law shall be voted upon separately. Should separate votes be taken on several amendments, a final vote shall be taken on the compromise proposal as a whole.

§ 11 Procedure in the Case of a Compromise Proposal Confirming the Adopted Bill

Should the compromise proposal provide for confirmation of the bill adopted by the Bundestag, no further decision by the Bundestag shall be required. The Committee Chair shall inform the Presidents of the Bundestag and the Bundesrat of the proposal without delay.

§ 12 Conclusion of the Procedure

(1) Any member may move that the procedure be concluded should no compromise proposal be adopted in the second meeting convened on the same subject.

(2) The procedure shall be concluded if there is no majority in favour of a compromise proposal at the subsequent meeting.

(3) The procedure may not be concluded in any other manner without a compromise proposal.

(4) The Committee Chair shall declare that the procedure is concluded and shall inform the Presidents of the Bundestag and Bundesrat without delay.

§ 13 Expiry

Should the Bundestag or Bundesrat take a decision to abrogate these Rules of Procedure, these Rules shall cease to be in force six months after such a decision is taken, unless the Bundestag adopts provisions on amendment, with the consent of the Bundesrat, prior to this.
